These limitations shall apply regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not Starbird Chicken has been advised of the possibility of such damage. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.

14.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency equitable relief before a court of competent jurisdiction in order to maintain the status quo pending arbitration, or to protect intellectual property rights. A request for interim measures shall not be deemed a waiver of the right to arbitrate.
